The Importance And Flexibility Of Sharia Law In Islam


In modern time Sharia is defined as a collection of ancient laws and regulations only. This modern definition of Sharia is not correct at all. Many people thinks that Sharia is not good any more for modern time and prefer secular laws in the state affairs. But the truth is that Sharia is not only a set of laws and regulation but also the proper way of life, the proper guidance of Allah. The one and only almighty Allah sent his prophet and messengers to the mankind to give the proper guidance which is Sharia. Following secular state of affairs

by ignoring Sharia is similar to ignore Allah’s guidance bought by holy prophet Mohammad peace be upon on him. Therefore following Secularism contradict Islam.


Muslim believes that Almighty Allah has created us for total servitude. Therefore Allah has given us the proper guidance to the right path through prophet Muhammad peace be upon him. It is impossible to show the servitude without the absence of the guidance. If we don’t follow the proper guidance of Allah then how would we complete the mission for which we were created? To complete this mission we must follow and apply sharia in our daily life. Therefore secular state of affairs should not be accepted in a Islamic country. Islam does not permit us to change or modify Allah’s Guidance bought by Prophet Muhammad peace be upon him. This is why we cannot ignore any part of sharia deliberately at any excuse ignoring sharia would be equal to ignoring Islam itself. The Arabic word Sharia means "a waterway that leads to a main stream, a drinking place, and a road or the right path."


From this meaning of concept we can easily estimate the importance of sharia in our life. Sharia is the guidance given by the creator of this universe. Now if human themselves create their own laws and regulation that would not take them to the right path. Ignoring Allah’s guidance will never be accepted in Islam. Allah Almighty says: “Is it a judgment of the time of (pagan) ignorance that they are seeking? Who is better than Allah for judgment to a people who have certainty (in their belief)?” (Al-Ma’dah: 50)” Therefore to become a proper Muslim and

Allah’s real servant we must follow and apply the laws of Sharia.


Many people have doubt about the flexibility and effectiveness of Sharia. According to them Sharia cannot be applied in new situations or Sharia does not have all the answers to resolve the problems of modern time. But the truth is that Sharia does have all the answers for any kind of situation. Almighty Allah has provided different sources such the Holy
 

Quran, Sunnah (examples of Prophet Muhammad peace be upon him), hadith. There are also some other secondary source such as ijma (consensus), qiyas (analogical deduction), ijtihad (personal reasoning), maslahah (public interest). From all these sources you can have any kind of answer for any new situation.


Some group of people thinks that Sharia is ineffective but if you examine closely you will notice that the countries following sharia Law has much lower crime rate than the countries with a complete secular state of affairs. Some people say that Sharia laws are too strict but in reality, showing mercy is one of the important elements of Sharia. The Prophet (s) said, “The Most Merciful shows mercy to those who have mercy on others. Show mercy to those on earth, and the One above the heaven will show mercy to you.”


If a country with the majority of Muslim follows Sharia laws then the non-Muslim might think that it will be unfair to force them to go through under such law. In this case they should know that Sharia Law is only obligatory for Muslim. A non-Muslim don’t have to go through Sharia law. For a non-Muslim different secular law should be applied.


So, from the all above statement it is clear that Islam is incomplete without the application of Sharia Law since it is the guidance from the creator. Secular laws which contradict sharia should not be accepted in Islam. Sharia Law is also very effective law for any country to find peace and prosperity.
